PRIVACY SHIELD NOTICE

GetSwift Limited and its U.S. subsidiary, GetSwift, Inc. (together, “GetSwift”, “we”, “us”), comply with the EU-U.S. Privacy Shield Framework and the Swiss – U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and Switzerland to the U.S.  GetSwift has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of notice, choice, onward transfer, security, data integrity, access and enforcement with respect to such personal data. Under the Privacy Shield Framework, GetSwift is also responsible for the processing of personal data that it receives from the E.U. and Switzerland and then transfers to a third party acting as an agent on its behalf.  We remain liable in accordance with the Privacy Shield Principles if third party agents that we engage to process such personal data on our behalf do so in a manner inconsistent with the Privacy Shield Principles, unless we prove that we are not responsible for the event giving rise to the damages.

In compliance with the Privacy Shield Principles GetSwift commits to resolve complaints about our collection or use of your personal information.  E.U. or Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact us at privacy@getswift.co.

GetSwift has further committed to refer unresolved Privacy Shield complaints to the following alternative dispute resolution provider located in the U.S.:

International Center for Dispute Resolution / American Arbitration Association (“AAA”), accessible at http://go.adr.org/privacyshield.html.

If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit AAA for more information or to file a complaint.  The services of AAA are provided at no cost to you.

Residents of the European Union or Switzerland may elect to arbitrate unresolved complaints but prior to initiating such arbitration, you must (1) contact GetSwift and afford us the opportunity to resolve the issue; (2) seek assistance from GetSwift’s designated independent recourse mechanism above; and (3) contact the U.S. Department of Commerce (either directly or through a European Data Protection Authority or the Swiss Federal Data Protection and Information Commissioner) and afford the Department of Commerce time to attempt to resolve the issue.  Each party shall be responsible for its own attorney’s fees and expenses. Please be advised that, pursuant to the Privacy Shield Framework the arbitrator(s) may only impose individual-specific, non-monetary, equitable relief necessary to remedy any violation of the Privacy Shield Principles with respect to the individual. The U.S. Federal Trade Commission (FTC) has jurisdiction over GetSwift’s compliance with the Privacy Shield.

In addition to the rights granted GetSwift users to access, modify and delete data we have collected from those users, some international users (including those whose information we collect under the Privacy Shield Framework) have certain legal rights to access certain information we hold about them and to obtain its deletion.  To exercise those rights, these users may contact us at privacy@getswift.co.
